Waiver of Limited Liability, Terms & Conditions of Stay Well Travels *

This Waiver of Limited Liability is valid for all trips/destinations with the Stay Well Travels. that you partake in from the day you place your deposit and until the return from the destination.

Terms of the Waiver of Limited Liability

In signing the reverse of this form I (the member) RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Stay Well Travels, its trustees, directors, agents or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or any relating to any loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, while traveling to/in the international or domestic destination(s). I voluntarily assume full responsibility for any risks of loss, damage or injury, including death, that may be sustained by me, or to any property belonging to me, while engaging in social activities or traveling to/in the international or domestic destination(s).

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THE REGISTRATION FORM ON THE REVERSE, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Terms & Conditions

Stay Well Travels which runs the STAY WELL TRAVELS as part of its program of activities. All trips/vacations (with the exception of most day-trips) are planned and organized by a dedicated in-house Travel Coordinator.

These are the standard booking conditions of Stay Well Travels

1. Agreement

By agreeing to partake in this event, you agree to accept the full Terms & Conditions (below) and Waiver of Limited Liability of Stay Well Travels.

2. Payment

Full deposit is required at the time of booking within this registration form. For all trips that are planned, once a deposit has been made you will receive a confirmation of registration and final terms under the payment agreement based on your elected choice. If payment is not paid when due, Stay Well Travels will be entitled to cancel the booking without notice.

3. Insurance

We believe that safety and enjoyment are equally important when traveling. It is therefore one of our terms and conditions of booking that you have adequate travel insurance in place before you travel; cover must include emergency medical expenses, personal accident and repatriation. In addition, we strongly recommend that you include baggage, personal liability and cancellation cover. Stay Well Travels will provide this for you at an additional cost.

4. Health

Where relevant, see your doctor to ensure that you are not travelling against medical advice.

As stated in point 4, it is the traveler’s responsibility to arrange insurance for any medical/repatriation needs you may have while on a trip. It would help if you took out an insurance policy before you travel.

5. Departure point/time

It is your responsibility to leave ample time for your journey to the departure point. The time stated on your ticket is the time of departure; you should ensure you are at the departure point three hours before an international fight and two hours for domestic fight. We cannot refund or re-book for your missing trips as a result of missing your departure time.

6. Travel Documentation

You are responsible for ensuring that you are in possession of the required travel documentation such as visas and passports and that they are valid and effective for all countries that you intend to visit. We cannot be held responsible for expenses incurred if travel documentation does not meet the required criteria. If you are in doubt, please contact the relevant embassy or STAY WELL TRAVELS travel coordinator. A valid passport is required for all journeys between countries for all nationalities.

US Citizens

Citizens of the United States do not require a passport for travel within the United States, however, participants must check with the relevant embassy before traveling. Requirements may change and you must check the up-to-date position in good time before departure.

All other Nationalities

Citizens of other countries should carefully check requirements for passports, visas and other documentation required for travel to your destination. Information can be found from the relevant embassy.

Stay Well Travels is NOT able to make refunds to participants unable to travel through failure to comply with immigration regulations. You should apply for your visa at the earliest opportunity as it can be a slow process. STAY WELL TRAVELS will provide a letter of information (detailing fights, accommodation, payment and support) for your visa application, once you have paid in full for the trip.

For all trips we ask that you bring the travel documents, insurance and other information provided by Stay Well Travels at final payment.

7. Refund & Cancellation policy

A full deposit is due at the time of booking. The initial deposit and cost for travel insurance is not refundable.

If you cannot travel, please inform Stay Well Travels. immediately.

If you fail to inform us that you cannot travel you may be subject to a fine equivalent to the subsidy STAY WELL TRAVELS has paid on the trip.

In the unlikely event your trip is cancelled by Stay Well Travels. or one of our suppliers because of unusual or unforeseen circumstances beyond our control, then we will receive a full refund of the price paid for the trip, but you will not be entitled to any compensation for the loss of the vacation/tour.

8. Variation of brochure

We reserve the right, before you book, to vary the services described in the brochures, including departure dates and characteristics and categories of transport/accommodation. You will be notified of any changes before traveling.

9. Alterations

After you book, it may occasionally be necessary to change the itinerary at the last minute, perhaps because of weather conditions, last-minute closures or travel delays, for example. Please be patient and adopt a flexible approach. Any change in content will be made on a like-for-like basis. All final content of the trip will be emailed to you one week prior to departure for day trips organized by STAY WELL TRAVELS and two weeks prior to departure for overnight trips, listing final accommodation, transport times, scheduled activities etc.

10. Behavior

You will be responsible for the conduct of yourself and you will indemnify us against any liability for damage caused by you. We ask you to participate fully in the trip and be considerate towards the whole group – the more you get involved the more fun you will have.

We ask that you take reasonable care of your own and others’ health and safety, carry out activities in accordance with instructions, and co-operate with the Group Leader in an emergency.

11. Complaints / Compliments

Should you have a problem during your tour, please contact your Group Leader at the time and they will do their best to rectify the situation. If we are unable to resolve your complaint at the time you can contact the Travel Coordinator.

To help us to continue to improve, we ask all participants on our trips to complete a questionnaire at the end of the trip. Your travel coordinator will organize this.

12. PANDEMIC/EPIDEMIC

As the world wide COVID-19 CoronaVirus pandemic remains ongoing at this time, I acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, these travel plans may be interrupted or cancelled by the supplier that is providing them, a government entity or other third party over which Agency has no control. I further acknowledge that the supplier’s own cancellation, re-booking and refund policies, subject to any applicable law that is now or may later be in effect, will govern my rights and remedies, including my right to receive a refund, in such an event. Moreover, I understand that should I elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances. I hereby agree to hold Agency harmless and release it from any and all liability for any damages, including but not limited to monetary losses, I may incur as a result of such interruption or cancellation of these travel plans.
